CONSECUTIVE SENTENCES—OFFENDER ON LICENCE

Where at the time of sentence an offender is serving a previous sentence from which he has been released on licence, and subsequently recalled following the revocation of the licence, and the sentencing judge is prevented by the Criminal Justice Act 2003 s.265, from imposing a sentence to run consecutively to the earlier sentence, it is not open to the judge to inflate the second sentence in order to ensure that the defendant does receive some additional punishment for the new offence.
